As a host provider, VirgoCube offers its customer (also known as “Subscribers”) and their customers and users the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. VirgoCube respects that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, VirgoCube reserves the right to take certain preventive or corrective actions. In order to protect these competing interests, VirgoCube has developed an Acceptable Use Policy (“AUP”), which supplements and explains certain terms of each customer’s respective service agreement, and is intended as a guide to the customer’s rights and obligations when using VirgoCube's services. This AUP will be revised from time to time.
One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet’s openness and value, but it also places a high premium on the judgment and responsibility of those who use it, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that VirgoCube cannot monitor, verify, warrant or vouch for the accuracy and quality of the information they acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet may be sexually explicit or otherwise offensive. Because VirgoCube cannot monitor or censor the Internet, and will not attempt to do so, VirgoCube cannot accept any responsibility for injury to its subscribers resulting from inaccurate, unsuitable, offensive or illegal Internet communications.
When subscribers disseminate information from the Internet, they must keep in mind that VirgoCube does not review, edit, censor or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information created is carried over VirgoCube's network and may reach a large number of people, including both subscribers and non-subscribers of VirgoCube, subscribers' postings to the Internet may affect other subscribers and may affect VirgoCube goodwill, business, reputation or operations. For these reasons, subscribers violate VirgoCube policy and the Service Agreement when they, their customers, affiliates or subsidiaries engage in the following prohibited activities:
1. Spam/E-mail Marker
VirgoCube enforces a zero-tolerance policy against spam, junk mail, and unsolicited commercial emails. This includes sending identical or substantially similar unsolicited electronic messages to multiple recipients.
A message is considered unsolicited if sent to someone who has not requested it or violates a forum or newsgroup charter unless it's sent to a legal entity's general email address associated with its domain. Sending messages to addresses registered with paid services (Gmail, Hotmail, etc.) is strictly forbidden, even if listed as an official email in the commercial register.
This ban also covers deceptive email headers and incorrect contact information.
Additionally, conducting unsolicited mass emailing through other providers that could imply VirgoCube's involvement is prohibited regardless of the origin of the message.
Unblocking: If Customer actions result in VirgoCube's email servers or IP ranges being blacklisted or flagged by online filtering software used by companies, a one-time abuse fee of $200 plus per mail $1 will be charged.
Mass emailing: Unsolicited mass emailing constitutes spamming. Unsolicited emails are those sent without express opt-in consent from natural persons receiving them. Mass emailers must keep complete records of all individuals who have opted into their mailings. All opt-in records (including relevant emails and headers) must be provided upon request by VirgoCube.
If verifiable evidence cannot be presented by the Customer, any recipient complaint will serve as proof they did not opt-in; thus making it unsolicited.
Mailing lists/newsletters: Restrictions on mass mailing apply here too. Mailing list/newsletter postings are allowed only if targeted at specific groups who have expressly opted in or made their addresses available for sharing information purposes only. They must allow automated unsubscription ensuring no further emails post-unsubscription.
To prevent unauthorized sending of emails, outgoing port 25/465/587 is blocked by default.
2. Hacking & Unauthorized Access
Attempting to gain unauthorized access to any system, network, or account.

Port scanning, vulnerability scanning, or brute-force attacks.

Exploiting security vulnerabilities without permission.
3. Malware & Malicious Software
Creating, hosting, or distributing viruses, worms, trojans, ransomware, or similar.
Running botnets, C2 (command-and-control) servers, or malicious automation.
Hosting phishing sites or credential-harvesting tools.
4. Denial-of-Service & Network Attacks
Launching or participating in DoS/DDoS attacks.
Generating excessive traffic aimed at overwhelming services.
Using our network to disrupt other networks.
If a Customer's Service attracts DoS or DDoS attacks, which disrupt or deny service to other Customers, VirgoCube will terminate that Client’s Service to maintain the quality of service for other Customers on the VirgoCube network.
5. Illegal Content & Activities
Hosting or sharing content that violates applicable laws.

Child sexual abuse material (CSAM).

Copyright infringement, including pirated software/media.

Fraud, identity theft, or impersonation.
Drugs, guns selling.
Privacy violations content.
6. Cryptocurrency Mining
Users are prohibited from using VPS services for any mining activities.
7. Account Registration
You must provide accurate, truthful, and up-to-date information during registration.
Accounts created with false or misleading information may be suspended or terminated without notice.
8. Proxies and VPN
Public open proxies, and anonymous proxies of any kind are strictly prohibited as they often facilitate illegal activities.
Private proxies are permitted if not used for illegal purposes.
TOR nodes are not allowed.
9. DMCA & Abuse Handling
Upon receiving a valid DMCA or abuse report, we will forward it to you.
You have 72 hours to resolve the reported issue.(CSAM is 24 hours)
Failure to comply will result in service suspension or termination.
10. Resource Usage Policy
To ensure fair access for all customers:
CPU Usage: You must not sustain CPU usage above 60% of your allocated resources for more than 1 hour continuously without prior approval.
Bandwidth: You must not exceed your allocated bandwidth limits. After exceeding your limit, your connection speed may be throttled to 10 Mbps.
Disk I/O: Please avoid activities that cause your VPS to consistently perform storage I/O operations exceeding 100 MiB/s for more than four hours. If usage surpasses this limit, we will notify you by email. Continued excessive usage after notification may result in temporary service suspension until resolved.
RAM: Usage must remain within allocated limits; swap usage should not cause performance degradation to other customers.
11. Investigations, suspensions, and security
VirgoCube reserves the right to suspend or terminate service and/or remove content in order to investigate potential violations of the terms of this AUP.
VirgoCube reserves the right to suspend Service provision to a Customer if there is reasonable suspicion that the Service is targeted by an attack or otherwise disrupts Service for other Customers, even if the Customer is not at fault.
VirgoCube will not make refunds for service suspensions associated with violations of the AUP by the Customer.
The Customer is liable for the use of their Service, even if such use was conducted by unauthorized persons or hackers.
The Customer is responsible for maintaining the security of their data and user accounts (including updating software and making and storing backups).
12. Reporting of AUP violations
VirgoCube requests anyone with any information regarding AUP violations to report it immediately by sending an e-mail to abuse@virgocube.com.
If you detect infringement of your intellectual property, e.g. a copyright, trademark or patent, you should contact the infringing party and request that they remove the content immediately. If the infringing party refuses to cease infringement or does not reply to your request within a reasonable term, you should notify VirgoCube at abuse@virgocube.com. Be sure to add to the reporting e-mail any information regarding your previous attempts to contact the infringing party, and any results thereof.
Furthermore, please add information regarding infringing materials hosted on our servers (Name of material and its domain or IP address). Furthermore, append official proof that you are the owner of the intellectual property.
All intellectual property reports that do not comply with the above requirements will be ignored by VirgoCube.
