1. Introduction
These Terms of Service (“Terms”) govern your use of the services provided by VirgoCube Limited (“we”, “our”, “us”). By ordering, using, or accessing our services, you agree to be bound by these Terms.
2. Service Provision
We provide web hosting, VPS, and dedicated server services subject to the availability of resources and network capacity. We reserve the right to refuse service at our sole discretion.
3. Payment & Billing
All invoices must be paid on or before the due date.
Failure to make payment by the due date may result in suspension or termination of service.
We are not responsible for any data loss resulting from late payment or service suspension.
Recurring services will be renewed automatically unless canceled in advance.
4. Refund Policy
Refund requests must be submitted within 24 hours of initial service activation.
For VPS services, refunds are only available for new customer if outbound traffic usage does not exceed 100 GB.
No refunds will be granted for dedicated servers or services terminated for violation of these Terms.
Refunds will be issued via the original payment method and it may takes 3-5 business days, please be patient.
5. Disputes
Abuse of PayPal disputes or chargebacks is strictly prohibited.
Initiating a dispute without first contacting our support team may result in immediate account termination and blacklisting.
6. Account Registration
You must provide accurate, complete, and truthful information when registering for our services. Accounts registered with false, misleading, or incomplete information may be suspended or terminated without notice. We reserve the right to request verification documents to confirm your identity and account details.
7. Data Loss & Liability
We are not responsible for any data loss caused by:
Force majeure events (natural disasters, power outages, network failures, etc.).
Hardware or software failures.
Customer actions or misconfigurations.
Failure to pay invoices on time.
You are solely responsible for maintaining your own backups.
8. Fair Resource Usage
You must use server resources (CPU, bandwidth, memory) responsibly.
Sustained CPU usage above 60% of the allocated vCPU for longer than 2 hours may be considered abusive and can result in throttling or suspension.
Occasional spikes up to 100% are allowed for short periods; however, long-term load should average below 80% to protect other users' performance.
9. Service Suspension & Termination
We may suspend or terminate your service if:
You violate these Terms or our Acceptable Use Policy.
We receive a valid abuse report or legal order.
You spread rumors about us on social media. (rumors only, normal comments are not included. You can say we are good or bad, but no rumors.)
10.Force Majeure
We shall not be held liable for any delay or failure to perform our obligations due to events beyond our reasonable control (“Force Majeure Events”). Such events include, but are not limited to:

Natural disasters (earthquakes, floods, hurricanes, storms, wildfires);

Acts of God;

War, terrorism, armed conflicts, or civil unrest;

Epidemics, pandemics, or public health emergencies;

Governmental actions, embargoes, or sanctions;

Strikes, labor disputes, or industrial actions;

Widespread power outages or failures of utility services;

Failure of telecommunications networks or Internet backbone providers;

Denial-of-service (DoS/DDoS) attacks or other large-scale cyberattacks;

Failures or outages of third-party data centers or upstream providers.
In the event of a Force Majeure Event, our obligations will be suspended for the duration of the event, and we will make reasonable efforts to resume services as soon as possible.
11.Limitation of Liability
To the maximum extent permitted by law:

We are not liable for any indirect, incidental, or consequential damages.

Our total liability for any claim shall not exceed the amount you paid for the service during the last billing period.
12.Changes to the Terms
We reserve the right to update or modify these Terms at any time. Updated Terms will be posted on our website with a revised “Last Updated” date.
